Waiver of Claims & Indemnity

Please read this form carefully and be aware in registering your minor child for participation in one or more Northbrook Hockey League (“NBHL”) hockey programs, you will be waiving and releasing all claims for injuries your minor child might sustain arising out of such program(s).

In consideration of my child’s participation in any of the Northbrook Hockey League (NBHL), including the Bluehawks, Jr. Bluehawks (formerly Jr. Spartans), athletics and sports programs, and all related events and activities (collectively, “Programs”), the undersigned acknowledges, understands and agrees that:

1. I am aware that the risk of injury and/or illness to any individual who participates in, attends or otherwise engages in any activity associated with (collectively, “participates” or “participation”) any of the Programs is significant, including the risk of permanent paralysis or death, and that such serious risks exist, notwithstanding the use of particular rules, equipment or personal discipline;
2. I am aware that the above risks include the risk that any individual who participates in any of the Programs could become exposed to a communicable disease, including COVID-19, and, as a result, become infected;
3. Understanding the risks described above, I agree, personally and on behalf of my minor child(ren) and/or ward(s), to KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASED PARTIES or others, and to assume full responsibility for the participation of my child(ren) and/or ward(s) in any and all of the Programs;
4. I agree, personally and on behalf of my child(ren) and/or ward(s), to comply with the stated rules, terms and conditions for participation in any of the Programs. I further agree, personally and on behalf of my child(ren) and/or ward(s), that if I observe any significant risk or hazard in connection with any of the Programs, I will remove myself and my child(ren) and/or ward(s), from continued participation in the Programs and immediately bring such risk or hazard to the attention of a NBHL Executive Committee Board representative;
5. To the fullest extent allowed by law, I, for myself and on behalf of my child(ren) and/or ward(s), HEREBY RELEASE AND HOLD HARMLESS the Northbrook Hockey League (NBHL), its board of directors, officers, officials, employees, agents, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of the premises used to conduct the event (collectively, "RELEASED PARTIES"), from, and INDEMNIFY the RELEASED PARTIES against, any and all present or future claims or causes of action for injuries, damages, loss, or wrongful death that I or any of my minor child(ren) and/or ward(s), may have, or that may accrue to me or to any of my minor child(ren) and/or ward(s), that result from, arise out of, or relate in any way to any of the Programs, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASED PARTIES OR OTHERWISE.
6. I HAVE READ THIS RELEASE OF LIABILITY AND INDEMNITY AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY AGREEING TO IT ON MY OWN BEHALF AND ON BEHALF OF MY CHILD(REN) AND/OR WARD(S), AND I SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

ACKNOWLEDGMENT BY PARENTS AND/OR LEGAL GUARDIANS OF YOUTH PARTICIPANTS: By executing this waiver and indemnity agreement, I agree to and verify the following:

1. I am the parent of, or legal guardian for, the minor child;
2. the date of birth of the minor child is correct;
3. as the parent/legal guardian with legal responsibility for the minor child, I consent and agree, both personally and on behalf of the minor child, to assume the risks of his/her participation in the Programs;
4. I specifically agree, both personally and on behalf of my child(ren) and/or ward(s), to release and hold harmless the RELEASED PARTIES from any and all claims or causes of action arising from or relating in any way to my participation, or the participation of my child(ren) or ward(s), in any of the Programs; and
5. I expressly agree to INDEMNIFY the RELEASED PARTIES from and against any and all claims or causes or action arising from or relating to my participation, or the participation of my child(ren) or ward(s), in any of the Programs, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASED PARTIES OR OTHERWISE.
